Negligent Security Leads to Fatal Stabbing of Father of Four

Daniel Walker and Mark Clark of Clark, Fountain, La Vista, Littky-Rubin & Whitman recently secured a Significant Confidential Settlement on behalf of the personal representatives of the estate of a father of four children who was fatally stabbed to death on the property of a residential apartment complex. 

The decedent was sitting outside with his sister in one of the common areas of the apartment complex when he was violently attacked without provocation by a tenant. Following the stabbing, the decedent was pronounced dead at a local Medical Center and law enforcement later identified and arrested the assailant.

A lawsuit was filed by Walker and Clark on behalf of the decedent’s estate and four surviving children against the owners of the property and management company of the apartment complex.

After filing suit, Walker and Clark conducted extensive discovery that revealed the property owner and management company failed to perform a background check on the assailant, despite having a history of violence, gang affiliations and sexual assault.

In addition, they established that the owner and operator failed to provide any on-site security and failed to follow up on reported complaints by other tenants regarding erratic behavior of the assailant.

As a result of the evidence they uncovered and after the corporate representative depositions were taken, Walker and Clark were able to obtain a significant confidential settlement on behalf of the estate and four surviving children. The family hopes that by holding the owner and operator accountable for the wrongful death of their father, it will improve the safety and security for all tenants and visitors of the apartment complex in the future.

Walker and Clark also secured a substantial confidential settlement for the decedent’s sister who suffered significant severe emotional trauma, post traumatic stress disorder and depression as a result of witnessing her brother stabbed to death and being splattered with his blood.
