Mark Clark Secures Significant Confidential Settlement in Defect Seatback Collapse Case

Clark Fountain is proud to announce that partner Mark Clark has successfully obtained a significant confidential settlement in a case involving a seatback collapse that rendered his client a paraplegic when the front seat in his pick-up truck collapsed during a rear-end collision.

The force of the impact caused the front seatback to fail and collapse rearward, leading to a rollover that resulted in severe spinal and head injuries.

Following the crash, Clark Fountain launched an extensive investigation to determine how and why the seatback failed. Working with mechanical engineers, metallurgists and biomechanical experts, the firm uncovered a critical defect in the truck’s seatback design. The structure lacked sufficient strength to withstand foreseeable rear end forces, allowing the recline mechanism and internal frame to give way under extreme inertial forces.

At impact, the truck was violently propelled forward. Because of inertia, the occupants’ bodies resisted that sudden movement, forcing their heads and torsos backward into the seatbacks with tremendous force. Instead of holding firm, the seatback components failed. Once the seatback declined beyond a critical angle, it could no longer restrain the occupant.

As the seat collapsed rearward, it dropped into the back cabin area, launching the front seat occupant backward. This motion, often referred to as rearward decline, caused the client to ramp up and over the seat, rendering the seatbelt ineffective. The very system designed to protect him was defeated by the seatback failure.

Crash data retrieved from the truck confirmed multiple impact events consistent with a rollover sequence. Expert analysis and discovery established that the seatback collapse was a primary cause of the life changing injuries. The client was effectively propelled into the rear of the vehicle, where he was exposed to extreme forces without protection. As a result, he suffered catastrophic harm, including severe spinal and head injuries.
