Zantac Lawsuits Consolidated in South Florida

Defective Products Product Recalls Wrongful Death BY

The U.S. Food and Drug Administration (FDA) recalled Zantac from the market on April 01, 2020, when the popular heartburn medication tested positive for N-Nitrosodimethylamine (NDMA), a “probable human carcinogen.”

Since then, more than 140 plaintiffs have filed lawsuits, alleging Zantac caused their cancer and/or seeking refunds and economic damages after purchasing a “dangerous or risky product.”

When this many plaintiffs come forward at the same time, the court system tends to centralize and consolidate the cases to “eliminate duplicative discovery, prevent inconsistent pretrial rulings,” and conserve resources. The United States Judicial Panel on Multidistrict Litigation (JPML) heard arguments to consolidate all federally filed Zantac lawsuits and decided to centralize them in the Southern District of Florida.

Injured Floridians and Wrongful Death Lawsuits

Many Florida residents were harmed as a result of Zantac. The multidistrict litigation also includes a Pennsylvania man’s wrongful death lawsuit, which alleges that the plaintiff’s wife died from cancer as a result of taking Zantac.

According to the complaint, 3 years of regular use of over-the-counter Zantac led to the woman’s death. The FDA found high levels of NDMA in samples of Zantac, and NDMA can create irreversible damage to DNA and incite cancer in cells and tissues. NDMA has also been linked to gastrointestinal cancers in a number of different studies.

Zantac’s manufacturer, Sanofi, was responsible for ensuring the quality of its product and warning consumers of any defects. Unfortunately, the drugmaker failed on all counts.

Plaintiffs are bringing forth counts of design defects, negligence, failure to warn, and more. Damages may account for medical monitoring, cancer treatments, pain and suffering, and even loss of consortium in wrongful death cases.
