Negligent Road Construction Leads to Death

A 35-year-old mother of two children was struck and killed by a dump truck. The accident occurred in an area that had been under construction for expansion for five months. On the morning of the accident, the decedent was unaware that the lanes under construction had been opened, pulled out of his development into the newly opened eastbound lanes, only to be struck and killed by an oncoming dump truck. A suit was brought against five defendants on behalf of the personal representative of the estate, including, the roadway contractor, Palm Beach County, the engineers who designed the roadway plans, the driver of the dump truck, and the residential development. The allegations against the defendants included the negligent maintenance of traffic, site obstructions, and failure to warn of the roadway opening.
