Manufacturing Defect Causes Woman’s Death in Rear-End Collision

A passenger in a rear-end collision sustained a fatal fracture of her upper neck after the metal support rod in her headrest fractured during the accident, causing the woman’s head to be unsupported at the time of the accident. Attorney Donald R. Fountain demonstrated that indentations in the metal support placed by the manufacturer to aid in the height adjustment of the headrest weakened the metal, and created a hinge point that led to the fracture, and reached a confidential settlement prior to trial.
